What To Know About Lush Heights

Please read carefully the terms and conditions for our Lush Heights before appending your signature to the space provided for the same on the subscribing form. Kindly note, that Photizo Properties Ltd will only accept the confirmation of subscription upon your acceptance and compliance with these terms and conditions. These terms and conditions shall be applicable to all subscribers, their assigns, and successors-in-title. Upon subscription, therefore, you are required to fill in all required details as contained in the official subscription form given to you by Photizo Properties Ltd correctly. The company shall not be liable for errors or misinformation in the cause of filling the form and any request for correction, amendment, or deletion resulting therefrom and affecting the survey and other documents shall attract extra charges. By signing in the provided space at the bottom of this document, you agree that you have received, read, understood, and hereby agree to be bound by terms and conditions as contained herein.

1. Payment And Documentation
Upon completion of all payments including the statutory fees, you will be given your payment receipt, invoice, and contract of sales. Deed of assignment will be available three weeks after the full payment has been made and survey plan will be given to you on the allocation day.

2. Allocation
The final and physical allocation shall be granted upon full payment of the total purchase price, including all the statutory fees.

3. Termination Of Contract
Photizo Properties Limited reserve the right to terminate your subscription when you subsequently fail to meet the payment plans, your failure to adhere to the terms and conditions contained herein or meet the purchase requirements. We will not take the responsibility to find a third party to acquire your property on your behalf rather, your subscription will be revoked and you shall be fully refunded but less 40% administrative fees.

4. Ownership
Your deposit does not guarantees you a portion of land in Lush Heights, it is only a show of your interest to own a property within the estate. The ownership of any portion of land in Lush Heights does not commence until the completion of all payments including the statutory fees.

5. Transfer of interest
In the event that you choose to sell your land after the allocation, you will be required to complete your change of ownership procedure. The applicable fees shall be a non-refundable sum of N100,000 (One Hundred and Thousand Naira Only) per plot. This transfer fee is subject to upward review and it is required to be paid before title is transferred to the new purchaser. Both parties are at liberty to agree on who bears the cost of transfer of interest. Where property is being transferred to a third party, the purchaser shall bear the cost of procuring a fresh survey plan, deed of assignment and any other documents relevant to title. The applicable cost shall be communicated to parties at the point of notification of transfer.

6. Land Size
The size of the land is usually 300SQM and 450SQM on the estate, however, the land measurements on the Survey Plan varies in number and most times below size, this measurement depends on the bearing of the land and does not mean your land is not complete. Your reliable surveyor can confirm this for you

7. Default
A default in your payment plan will attract monthly 5% interest on past due amount. In a case of 2 successive defaults within 6 months, your subscription shall be terminated and you will be fully refunded but less 40% administrative fees.

8. Maintenance
Maintenance of your undeveloped property after allocation must be done frequently. The company will not be responsible for the clearing and maintenance of your undeveloped property after allocation and it may attract a fine after two consecutive notice.

9. Refund
All request for refund will be processed within 60 days upon which you will be fully refunded but less 40% administrative fees.

10. Amendation Of This Terms And Conditions
This Terms and Conditions remains the integral part of the transaction and Photizo Properties Limited reserves the right to amend it to accommodate changes in market/industry situations.

The Deed of Assignment and survey will be ready 3 weeks after the full payment has been made. Clients will beresponsible for their survey.

5. Would there be infrastructure Levy?
No, It's included in the cost of property.

6. How much is the documentation?
The charges for documentation is 2% of the actual property value

7. When will my plot(s) be allocated to me?
3 weeks after the completion of all payments

7. What do I get after completion of payment?
Invoice, Receipt, Contract Of Sales. The Dead Of Assignment will be provided 3 weeks after all payments has been made.

8. What does it take to acquire a comercial plot and or a corner piece?
Commercial plots and corners place attract a 40% surcharge.

9. What type of title does Lush Heights have on the Land?

10. Is the road to the estate motor - able?
Yes, the road leading to the estate is motor-able

11. Is there a time frame before the commendment of work can start on my land after location?
No, there is no time limit to commence work, but maintenance of the undeveloped plots must be done frequently

13. Can I re-sell my plots or property?
A subscriber can resell his/her property. However, a letter of notice of ownership transfer should be written to Photizo Properties Limited
