Please read these terms and conditions carefully
before subscribing to The April Heights Estate
by appending your signature to
the space provided below. Note that Photizo
Properties and Investment Ltd will only accept
the
confirmation of subscription
upon your acceptance and compliance with these
terms and conditions. These terms and conditions
shall be applicable to all
subscribers, agents, legal representatives,
assigns, and their successors-in-tle. Upon
subscription, you are required to fill in all
required details as contained in the official
subscription form given to you by Photizo
Properties
and Investment Ltd. The
company will not be liable for errors or
misinformation in the cause of filling the form.
And every request for correction shall
attract extra charges to correct in your survey
and other documents.
The terms and conditions is an integral part of
the
subscription and should be read thoroughly. By
signing in the provided space
at the boom of this document, you agree that you
have received, read, understood, and agreed to
be bound by the terms as
contained herein.
1.
Payment And Documentation
Upon completion of all payments, you will be given
your payment receipt, invoice, and contract of sales
and your Deed of
Assignment will be ready after 90 days. Your
allocation
details shall be final and you will receive your
Survey Plan on the day of
allocation.
2.
Allocation
The final and physical allocation shall be granted
after
the full payment of the total cost of the property
has been made. The
allocation will be done within 6 months after
completion
of payments. This is to enable us to plan properly
for the allocation.
3.
Termination Of Contract
Photizo Properties and Investment Limited reserves
the
right to terminate your subscription when you
subsequently fail to meet
the payment plans, your failure to adhere to the
terms and conditions contained herein, or your
purchase requirements.
4.
Ownership
Your deposit does not guarantee you a poron of land
in April Heights Estate, it is only a show of your
interest to own a property
within the estate. The ownership of any portion of
land in The April Heights Estate does not commence
until the completion of
all payments.
5.
Transfer of Ownership
Third parties must have a file with us and fill out
the required form and In-house change of ownership
will incur a fee of 2% of
the value of the property being sold. Also, the
company will not be at liberty to produce a new
survey or any document for the
property as the owner and the purchaser should sort
to get a new surveyor and legal practioner. For all
3rd-party transfers of
ownership, the following protocols must be adhered
to.

Land Size
The size of the land is usually 500SQM on the
estate, however, the land measurements on the Survey
Plan vary in number and
most times below 500SQM, this measurement depends on
the bearing of the land and does not mean your land
is not complete.
Your reliable surveyor can confirm this for you.
7.
Default
In the event that the purchaser defaults on their
installment payments, the total amount paid up to
the end of the payment plan
duration will be calculated and the cost of
documentation will be deducted. The portion of the
property that the remaining
payments cover will be allocated to the purchaser
based on the proportional amount paid. No refunds
will
be issued for any
payments made under the installment plan.
7.
Refund Policies
Refund requests will only be granted to ongoing
transactions. All refund requests will be processed
within 120 days upon
which you will be fully refunded but less 30%
administrative fees.
NO REFUND ON CONCLUDED
TRANSACTIONS:
Once a client has fully paid for their
plot/house
and requests a buyback, the following procedures
will be implemented:
- The transaction will be marketed to a 3rd
party
- No refund will be issued until the sales
transaction is concluded.
- We may act as a markeng intermediary to
facilitate the sale of the plot, with a 5%
transaction fee charged upon successful
closure.
- Realtors representing such clients must also
market the property.
8.
Amendment of this Terms And Conditions
These Terms and Conditions remain an integral part
of
the transaction and Photizo Properties Limited
reserves
the right to
amend it to accommodate changes in market/industry
situations.
